Terms of service

These terms apply between you (the business using AgriDesk) and [Registered company name] (Pty) Ltd, registration number [CIPC registration number].

1. The service

AgriDesk is online payroll software for South African employers. It helps you keep employee records, calculate pay, deductions and leave, produce payslips and prepare figures for your EMP201 and EMP501 returns.

2. Your account

• The person who creates a business on AgriDesk confirms they are authorised to accept these terms for that business.
• You decide who on your team gets access and what they can see. You are responsible for what your users do in your account.
• Keep sign-in details private and tell us straight away if you think your account has been misused.

3. Payroll figures are your responsibility

AgriDesk calculates PAYE, UIF, SDL, leave and other amounts from the information and settings you enter, using published SARS tables and labour law rules. The calculations are estimates to help you. You remain the employer and remain responsible for:

• checking pay, deductions and payslips before you pay staff or submit anything to SARS or the Department of Employment and Labour;
• submitting returns and paying amounts due on time;
• complying with the Basic Conditions of Employment Act, sectoral determinations, the National Minimum Wage Act and any other law that applies to you.

AgriDesk does not submit returns to SARS on your behalf and does not provide tax, legal or accounting advice.

4. Your data

You own the information you put into AgriDesk. We process personal information about your employees only on your instructions, as set out in the data processing agreement, which forms part of these terms. How we handle your own users' information is set out in the privacy policy.

5. Fees

Fees, billing periods and payment terms are shown when you subscribe. Prices include VAT where applicable. We will give you at least 30 days' notice of price changes.

6. Availability and changes

We aim to keep AgriDesk available at all times but cannot promise it will never be interrupted. We may improve or change features; we will tell you in advance about changes that materially reduce what the service does.

7. Liability

To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, or for penalties or interest charged by SARS or other authorities as a result of figures you did not check. Nothing in these terms limits rights you have under the Consumer Protection Act where it applies to you.

8. Ending the service

You can stop using AgriDesk at any time. Before you close your account you can export your data. After closure we delete or anonymise your data as described in the data processing agreement, except records we must keep by law.

9. General

These terms are governed by the law of the Republic of South Africa. We may update these terms; we will tell you about material changes before they take effect. Contact us at [support email address] or [Registered address].
